The High Court of Kenya has overturned a judgment delivered in December 2025 in favor of a litigant who had secretly used artificial intelligence (AI) tools to draft his pleadings. The court held that this practice, not governed by Kenyan law, constituted an abuse of process and a violation of procedural rules, as it conferred an unfair advantage and undermined the fairness of the trial. Although the claimant had invoked a failure to respond within the prescribed time, it was the lack of transparency regarding the use of AI that led to the annulment. The judgment has therefore been quashed, and the court has called for reform to regulate the use of AI within the judicial system.
